How did the Founders decide on the unique system of federalism established in the Constitution?
Professor Kurt Lash explores both the tensions and the aspirations that led to the formation of a government that is national and federal. The people of the individual states wished to maintain their independence, creating a demand for federalism. At the same time, there was a desire for some kind of national union that would protect the country as a whole. The result was a compromise.
Professor Kurt T. Lash holds the E. Claiborne Robins Distinguished Chair in Law at the University of Richmond School of Law. He is the Founder and Director of the Richmond Program on the American Constitution.
As always, the Federalist Society takes no position on particular legal or public policy issues; all expressions of opinion are those of the speaker.
